These Terms govern your use of MyLastSmoke.com and any services you purchase from Elevated Minds LLC ("we," "us," "our"). By booking a session, you agree to these Terms. Please read them before purchasing.

1. What We Provide

We provide hypnotherapy and related coaching services for smoking and vaping cessation, delivered one-on-one by video call. A standard engagement consists of one session of approximately 60 minutes, plus one complimentary follow-up session where the conditions in Section 5 are met.

Engagement begins with a discovery call, scheduled through our website at no charge. The discovery call is a conversation to determine whether this program is an appropriate fit for you and to answer your questions. It carries no obligation and no payment.

If, following the discovery call, both parties agree to proceed, we will send you a link by email to schedule and pay for your session, together with a short intake form. We use the intake to confirm suitability and to prepare your session. If at any point before the session we determine that you are not a suitable fit, we will tell you; if you have already paid, you receive a full refund.

Our services are educational and self-improvement services. They are not medical care, psychotherapy, psychiatric treatment, or a substitute for advice from a licensed healthcare provider. See our Disclaimers for full detail.

Elevated Minds LLC carries professional liability insurance through the Energy Medicine Professional Association.

2. Eligibility

You must be at least 18 years old to book a session. By booking, you confirm that you are 18 or older and that the information you provide is accurate and complete.

We reserve the right to decline or discontinue service — including on the basis of your intake responses — where we believe hypnotherapy is not appropriate, where a client may be better served by a licensed medical or mental-health professional, or where a client is under the influence of alcohol or non-prescribed substances at the time of the session. If we decline service before the session takes place, you receive a full refund.

Where we serve

We provide services online to clients throughout the United States. Regulation of hypnotherapy and related complementary services varies from state to state. We offer services only where it is lawful for us to do so, and we reserve the right to decline a booking if we cannot lawfully serve your location. If we decline for this reason, you receive a full refund.

You are responsible for ensuring that your participation complies with the laws of the state in which you are located at the time of your session.

3. Booking and Payment

Scheduling a discovery call is free and creates no payment obligation. The terms below apply to the paid session that may follow it.

• Introductory rate: the session fee is $500 USD for the first five (5) clients to book at that rate.
• Standard rate: once those five introductory bookings have been taken, the session fee is $999 USD.
• The fee is payable in full at the time you schedule your session, using the link we send you by email after the discovery call.
• Payment is processed securely by Stripe. Your session is confirmed once payment is complete.
• The introductory rate is limited in number, may be withdrawn at any time, and applies only while this site displays it as available. Prices may otherwise change at any time. The price stated in the link we send you is the price that applies to your session, and any refund under Section 5 is a refund of the amount you actually paid.
• You are responsible for any taxes that may apply in your jurisdiction.

4. Rescheduling and Cancellation

You may reschedule or cancel a discovery call at any time, for any reason, at no cost. The terms below apply to your paid session.

If we need to reschedule for any reason, you may choose a new time at no cost or receive a full refund.

5. The Guarantee

We offer a money-back guarantee. It works as follows.

What you receive

• Your initial session of approximately 60 minutes.
• If you are still smoking or vaping 30 days after your initial session, one complimentary follow-up session at no additional cost. The follow-up is requested after that 30-day mark and must be completed within 60 days of your initial session.
• If you are still smoking or vaping after the follow-up session, a full refund of the fee you paid.

Conditions

To qualify for a refund, all of the following must be true:

1. You completed the pre-session intake accurately and in full, including disclosure of relevant health conditions and medications.
2. You attended your initial session in full.
3. You were still smoking or vaping 30 days after your initial session, and you requested and attended the complimentary follow-up session, which took place within 60 days of your initial session.
4. You followed the reasonable instructions and recommendations given during your sessions.
5. You submit your refund request in writing to info@mylastsmoke.com within 30 days after your follow-up session, and in no event later than 90 days after your initial session.

Requests received after the 90-day guarantee period, or where the above conditions have not been met, are not eligible. Approved refunds are issued to the original payment method within 14 business days.

The guarantee applies to the initial session fee only. It is offered once per client and does not apply to any additional or subsequent services purchased.

6. Your Responsibilities

To get the benefit of the session, you agree to:

• Complete the pre-session intake accurately before your session, including any relevant medical or mental-health history.
• Attend at your scheduled time, in a quiet and private space, free from interruption for the full 60 minutes.
• Use a device with a working camera, microphone, and reliable internet connection.
• Not attend under the influence of alcohol or non-prescribed substances.
• Not operate a vehicle or machinery during the session.

7. Session Recording

Sessions are recorded only with your express consent, requested and given before recording begins. You may decline without affecting the service you receive. Because several states — including Washington — require the consent of every party to a recorded conversation, we obtain consent from all participants in every session regardless of your location. You may not record any session without our prior written consent.

8. Confidentiality

We treat what you share with us as confidential and handle it as described in our Privacy Policy. Please note that because we are not a licensed medical or mental-health provider, our services are not covered by HIPAA or by legal therapist–patient privilege. We may disclose information where required by law or where there is a serious risk of harm to you or another person.

9. Intellectual Property

All content on this website and all materials, recordings, audio, and written resources provided in connection with our services are the property of Elevated Minds LLC. You may use them for your own personal benefit. You may not copy, distribute, resell, or publish them without our written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Elevated Minds LLC and its owner are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this website or our services. Our total liability arising from or relating to the services is limited to the amount you paid us for those services.

You acknowledge that results vary between individuals and that no specific outcome is promised or guaranteed beyond the refund terms stated in Section 5.

11. Indemnification

You agree to indemnify and hold harmless Elevated Minds LLC and its owner from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the services.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be brought in the state or federal courts located in Washington State, and you consent to that jurisdiction.

Nothing in this section waives any non-waivable consumer protection right you hold under the laws of the state in which you reside. Where the mandatory consumer law of your home state conflicts with these Terms, that law controls to the extent of the conflict.

Before initiating any formal proceeding, you agree to first contact us at info@mylastsmoke.com and attempt in good faith to resolve the matter directly.

13. Changes to These Terms

We may update these Terms. The version in effect at the time you pay for your session is the version that applies to your purchase. Continued use of the site after changes constitutes acceptance of the updated Terms.
