Elevated Minds LLC ("we," "us," "our") operates MyLastSmoke.com and provides online hypnotherapy services for smoking and vaping cessation. This policy explains what information we collect, why we collect it, how we use and protect it, and the choices you have.
By using this website or booking a session, you agree to the practices described here.
1. Information We Collect
Information you give us
- Booking information: your name, email address, phone number, time zone, and any details you provide when scheduling your discovery call or your session.
- Intake information: responses to a short pre-session intake covering your smoking or vaping history, previous quit attempts, health background, and goals for your session. We use it to confirm that the program is an appropriate fit for you and to prepare your session.
- Session information: notes taken during or after your session relating to your goals and progress.
- Correspondence: emails, messages, and any other communication you send us.
- Mailing list: your first name and email address, if you opt in to receive promotional emails, updates, and quitting tips. We send these only where you have ticked the consent box, and every email contains an unsubscribe link.
Payment information
Payments are processed by Stripe, Inc. We do not collect, see, or store your full card number, CVV, or bank details. Stripe handles that information directly under its own privacy policy and security standards. We receive only limited confirmation details such as the last four digits of the card, the transaction amount, and whether the payment succeeded.
Information collected automatically
Like most websites, our site and the services embedded in it may automatically collect technical information such as your IP address, browser type, device type, referring page, and pages viewed. This is used to keep the site working and to understand general traffic patterns.
2. Consumer Health Data
All clients: Under the Washington My Health My Data Act — and similar consumer health data laws in Nevada, Connecticut, and other states — some of the information you share with us — including details about smoking, vaping, nicotine use, and related health goals — may qualify as "consumer health data."
We collect this information only to provide the services you request. We do not sell consumer health data. We do not share it for advertising purposes. You may request access to, or deletion of, this data at any time by emailing info@mylastsmoke.com, and we will respond within the timeframes required by applicable law.
3. How We Use Your Information
- To schedule, prepare for, and deliver your session
- To assess, from your intake responses, whether the program is an appropriate fit for you
- To process payment and issue refunds where applicable
- To communicate with you about your appointment, follow-up session, and results
- To maintain records of services provided
- To send occasional emails about our services, if you have opted in
- To comply with legal, tax, and accounting obligations
4. Service Providers We Use
We rely on a small number of third-party services to operate. Each maintains its own privacy policy:
- Calendly — appointment scheduling and booking forms
- Stripe — payment processing
- Google Workspace — business email, calendar, and video conferencing
- Netlify — website hosting and handling of our contact and mailing-list forms
- Vimeo — hosting and playback of the explainer video on our site
- Google Fonts — website typography
We share your information with these providers only to the extent needed to deliver the service. We do not sell your personal information to anyone, and we do not share it with advertisers or data brokers.
5. Session Recording
Sessions are recorded only with your explicit consent, requested before recording begins. You may decline, and declining will not affect the service you receive. If you consent, recordings are stored securely, used only for your benefit and our professional records, and never shared publicly or used in marketing without your separate written permission. You may request deletion of your recording at any time.
6. Cookies and Similar Technologies
Our site uses a minimal set of cookies. Some are necessary for the site to function — including one that records that you have dismissed our cookie notice, so it is not shown to you again for a year. Others are set by embedded third-party services — most notably Calendly, which operates the booking widget, and Vimeo, which plays the explainer video. We do not use advertising or cross-site tracking cookies.
You can control or delete cookies through your browser settings. Blocking cookies may prevent the booking widget from working correctly.
7. How We Protect Your Information
Our website uses HTTPS encryption. We use reputable service providers with industry-standard security practices, and we limit access to your information to what is necessary to provide the service. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. How Long We Keep Information
We retain booking, intake, and session records for as long as needed to provide services and to meet legal, tax, and professional record-keeping obligations — generally not less than the period required by applicable law. Marketing email addresses are kept until you unsubscribe. You may request deletion at any time, subject to records we are legally required to keep.
9. Your Rights and Choices
- Access: request a copy of the personal information we hold about you
- Correction: ask us to fix information that is inaccurate
- Deletion: ask us to delete your information, subject to legal retention requirements
- Withdraw consent: withdraw consent to recording or marketing at any time

We serve clients throughout the United States, and privacy rights differ by state. If you live in a state with a comprehensive consumer privacy law — including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Nebraska, New Hampshire, New Jersey, Iowa, Indiana, Tennessee, Minnesota, Maryland, Kentucky, Rhode Island, or others as they take effect — you may have rights to access, correct, delete, or obtain a portable copy of your personal information, to opt out of certain processing, and to appeal a denial of your request.
We honor these rights for every client, regardless of the state you live in. We do not sell personal information, we do not share it for cross-context behavioral advertising, and we do not use it for automated decision-making or profiling. California residents are additionally entitled to be free from discrimination for exercising these rights, and we do not discriminate.
If we deny a request, you may appeal by replying to our response. If your appeal is denied, you may be able to complain to your state Attorney General.
Several states, including Washington, Nevada, and Connecticut, provide heightened protection for consumer health data. Because our services concern smoking, vaping, and nicotine use, we treat all such information as protected health data for every client, regardless of residence.
10. Children
Our services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
11. Changes to This Policy
We may update this policy from time to time. The "last updated" date above will reflect any changes. Material changes affecting how we handle your information will be communicated to active clients by email.
